Areas that apply specifically to "Jobseekers" or specifically to "Employers" will be noted as such.
Use of Material
The layout, design, concept and organization of the MyDentalJobs.com Site and Services are subject to MyDentalJobs.com patents, copyrights and other intellectual property rights. All rights are reserved. You acknowledge and agree that MyDentalJobs.com owns all right, title and interest in (i) the Services; (ii) the Site; (iii) the technology available on the Services or the Site; and (iv) all copyrights, patents, trademarks and other intellectual property rights therein. Unauthorized use of the Material may violate copyright, trademark, and other laws. You may not sell or modify the Material or reproduce, display, publicly perform, distribute, or otherwise use the Material in any way for any public or commercial purpose. The use of the Material on any other web site or in a networked computer environment for any purpose is prohibited.
You shall not copy or adapt the code, HTML, Javascript, or otherwise, that the Company creates to generate its pages.
Web Site Security Rules

General
The Company does not represent or guarantee the truthfulness, accuracy, or reliability of communications posted by users or endorse any opinions expressed by users. You acknowledge that any reliance on material posted by other users will be at your own risk. The Company has no obligation to screen communications in advance and is not responsible for screening or monitoring material posted by users. If notified by a user of communications which allegedly do not conform to this Agreement, the Company may investigate the allegation and determine in good faith and its sole discretion whether to remove or request the removal of the communication. The Company has no liability or responsibility to users for performance or nonperformance of such activities. The Company reserves the right to expel users and prevent their further access to the Web Site for violating this Agreement or the law and the right to remove communications which are abusive, illegal, or disruptive. The Company is not to be considered an employer with respect to your use of the Web Site and the Company shall not be responsible for any employment liabilities or decisions, for whatever reason, made by any entity posting jobs on the Site.
Acceptable Site Use
The Web Site may be used only for lawful purposes by individuals seeking employment and career information and employers seeking employees.
General Rules: Users may not use the Web Site in order to transmit, distribute, store or destroy material (a) in violation of any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others, or (c) that is defamatory, obscene, threatening, abusive or hateful.
Specific Prohibited Uses
The Company specifically prohibits any use of the Web Site, and all users agree not to use the Web Site, for any of the following:
- Posting any incomplete, false or inaccurate biographical information or information which is not your own.
- Posting an ad that contains more than one position.
- Posting an ad for anything other than a bona fide employment position.
- Contacting a user for any reason other than a bona fide employment position.
- Posting material that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to another user or any other person or entity.
- Posting sexually-explicit images or statements
Registration
To utilize some of the MyDentalJobs.com services, we require a registration process whereby users select a member name ("E-mail ID") and a password. Your E-mail ID will be used to identify you on MyDentalJobs.com. You may login onto MyDentalJobs.com, use the services or modify your information, only through your E-mail ID and password. By registering, you certify that the email address you provide in the registration is accurate and belongs to you.
You are responsible for maintaining the confidentiality of your user information. You shall be responsible for all uses of your registration, whether or not authorized by you. You agree to immediately notify the "Company" of any unauthorized use of your registration or password.
Employers
The Resume and Job Posting Database is only to be accessed by Employer subscribers of this service. A Employer subscriber is defined as one unique user with one unique Employer password. If Employer subscriber (including any of your employees or consultants) are found to share passwords with any non-subscribers, we will terminate your subscription and no refund will be provided. Employer acknowledges and agrees that Employer is solely responsible for the form, content and accuracy of any job posting or material contained therein placed by Employer on the Web Site.
Jobseekers
Jobseeker acknowledges and agrees that you are solely responsible for the form, content and accuracy of any resume or material contained therein placed by you on the Web Site.
The Company's Liability
The Material on this site may contain inaccuracies or typographical errors. The Company makes no representations about the accuracy, reliability, completeness, or timeliness of the Web Site or the Material. The use of the Web Site and the Material is at your own risk. Changes are periodically made to the Web Site and may be made at any time.
You acknowledge and agree that you are solely responsible for the form, content and accuracy of any material placed by you on the Web Site.
THE COMPANY DOES NOT WARRANT THAT THE WEB SITE WILL OPERATE ERROR-FREE OR THAT THE WEB SITE AND ITS SERVER ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF THE WEB SITE OR THE MATERIAL RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, THE COMPANY IS NOT RESPONSIBLE FOR THOSE COSTS.

Disclaimer of Consequential Damages
IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS OR LICENSORS, OR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING OR DELIVERING THE SERVICES, TECHNOLOGY OR CONTENT AVAILABLE ON THE SERVICES ("MYDENTALJOBS.COM"), BE LIABLE TO YOU IN ANY MANNER WHATSOEVER FOR ANY DAMAGES WHATSOEVER (WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF REPUTATION) RESULTING FROM THE USE OR INABILITY TO USE THE WEB SITE AND THE MATERIAL, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
YOUR SOLE AND EXCLUSIVE REMEDY WITH RESPECT TO THE USE OF ANY SERVICES PROVIDED BY MYDENTALJOBS.COM SHALL BE CANCELLATION OF YOUR MEMBERSHIP TO THE SERVICES AND/OR TERMINATION OF YOUR USE.
Indemnity
You agree to defend, indemnify, and hold harmless the Company, is officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the Material or your breach of the terms of this Agreement.
Termination
The Company reserves the right, at its sole discretion, to terminate your registration, delete any or all of your postings, or block access to the Web Site and/or any other service provided to you by the Company.
We reserve the right to take these actions, with or without notice, and without any liability to the account holder or user. . We reserve the right to revise, reclassify or reject any advertisement.
Links to Other Sites
The Web Site contains links to third party web sites. These links are provided solely as a convenience to you and not as an endorsement by the Company of the contents on such third-party Web sites. The Company is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third-party Web sites. If you decide to access linked third-party Web sites, you do so at your own risk.
Severability
If any provision of this Agreement or portion thereof is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Applicable Law and Jurisdiction
This Site (excluding links) is controlled and operated from our offices in Morgan Hill, California. You agree that all matters arising from or relating to the use and operation of the Site and Services shall be governed by the laws of the State of California and the United States of America, without regard to conflicts of laws principles. This Agreement also shall be governed by and construed in accordance with the laws of the State of California and the United States of America. The federal and state courts of the State of California located in San Jose shall have exclusive jurisdiction to adjudicate any dispute arising out of this Agreement or arising from or relating to the operation or use of the Site or Services. You expressly consent to (i) the personal jurisdiction of such courts over you; and (ii) service of process being effected upon you by either email or registered mail sent to the address you provide MyDentalJobs.com in connection with your subscription for services. Unless prohibited by the law of your jurisdiction, you waive any requirement that service of process or of any documents be made upon you pursuant to the provisions of The Hague Service Convention.
